Second Additional Protocol to the Protocol between the Republic of Peru and the Kingdom of Thailand
to Accelerate the Liberalization of Trade in Goods and Trade Facilitation

THE GOVERNMENT OF THE REPUBLIC OF PERU AND THE GOVERNMENT OF THE KINGDOM OF THAILAND (hereinafter
referred to as the “Parties”);

RECALLING the Framework Agreement on Closer Economic Partnership between the Government of the Republic of Peru and the Government of the Kingdom of Thailand, done at Bangkok, Thailand on 17 October 2003 (hereinafter referred to as the “Framework Agreement”);

RECALLING the Protocol between the Republic of Peru and the Kingdom of Thailand to Accelerate the Liberalization of Trade in Goods and Trade Facilitation done at Busan, the Republic of Korea, on 19 November 2005 (hereinafter referred to as the “Protocol”);

RECALLING the Additional Protocol to the Protocol between the Republic of Peru and the Kingdom of Thailand to Accelerate the Liberalization of Trade in Goods and Trade Facilitation done at Hanoi, Socialist Republic of Vietnam, on 16 November 2006 (hereinafter referred to as the “Additional Protocol”);

FURTHER RECALLING that paragraph 3 of Article 3 of the Additional Protocol provides that the Parties shall enter into consultations to discuss any necessary revisions for the changes into the Harmonized Commodity Description and Coding System 2007 (hereinafter referred to as the Harmonized System 2007”) including Attachment I to the Additional Protocol;

NOTING the completion of the consultations between the Parties pursuant to paragraph 3 of Article 3 of the Additional Protocol on the necessary revisions for the changes into the Harmonized System 2007 including Attachment I to the Additional Protocol;

REAFFIRMING the undertakings of the Parties to endeavor to progressively liberalize and promote trade in goods between the Parties, facilitate the movement of goods between the territories of the Parties, and strengthen and enhance economic partnership between the two countries;

HAVE AGREED AS FOLLOWS:

ARTICLE 1
AMENDMENTS ON THE LIST OF GOODS BASED ON THE HARMONIZED SYSTEM 2007

Appendix 1 (List of Goods) as referred to in paragraph 4 of Article 3 of Annex 1 to the Protocol shall be replaced by the new Appendix 1 (List of Goods) which appears as Attachment 1 to this Second Additional Protocol.

ARTICLE 2
AMENDMENTS ON THE SPECIFIC RULES OF ORIGIN BASED ON THE HARMONIZED SYSTEM 2007

Appendix I as referred to in paragraph 1 of Article 13 of Annex 2 to the Protocol which appears as Attachment 1 to the Additional Protocol (Headnotes to Appendix 1 (Product Specific Rules of Origin) and Specific Rules of Origin) shall be replaced by the new Appendix I (Headnotes to Appendix 1 (Product-Specific Rules of Origin) and Specific Rules of Origin) which appears as Attachment 2 to this Second Additional Protocol.

ARTICLE 3
FINAL PROVISIONS

1. This Second Additional Protocol related to the amendments on the List of Goods and Specific Rules of Origin based on the Harmonized System 2007 between the Republic of Peru and the Kingdom of Thailand and its Attachments shall form an integral part of the Protocol.

2. Each Party shall notify the other Party of the completion of its internal procedures for the entry into force of this Second Additional Protocol related to the amendments on the List of Goods and Specific Rules of Origin based on the Harmonized System 2007 between the Republic of Peru and the Kingdom of Thailand.

3. This Second Additional Protocol shall enter into force thirty (30) days after the date of receipt of the latter of the notifications referred to in paragraph 2.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective governments, have signed this Second Additional Protocol to the Protocol between the Government of the Republic of Peru and the Government of the Kingdom of Thailand to Accelerate the Liberalization of Trade in Goods and Trade Facilitation.

DONE at Singapore, on this 13th day of November 2009; in duplicate, in Spanish, Thai, and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.
