Additional Protocol to the Protocol between the Kingdom of Thailand and the Republic of Peru
to Accelerate the Liberalization of Trade in Goods and Trade Facilitation

THE GOVERNMENT OF THE KINGDOM OF THAILAND AND THE GOVERNMENT OF THE REPUBLIC OF PERU (hereinafter referred to as the “Parties”),

RECALLING the Framework Agreement on Closer Economic Partnership between the Government of the Kingdom of Thailand and the Government of the Republic of Peru, done at Bangkok, Thailand, on 17 October 2003 (hereinafter referred to as the “Framework Agreement”);

FURTHER RECALLING the Protocol between the Kingdom of Thailand and the Republic of Peru to Accelerate the Liberalization of Trade in Goods and Trade Facilitation, done at Busan, the Republic of Korea, on 19 November 2005 (hereinafter referred to as the “Protocol”), in pursuant to the undertaking of the Parties to liberalize trade in goods under Article 2 of the Framework Agreement;

RECOGNISING that paragraph 3 of Article 2 of the Protocol provides that the Parties agree to continue their negotiations on Specific Rules of Origin and its related issues, the outcome of which will be an integral part of the Protocol once approved by the Parties in accordance with their own internal procedures;

NOTING the completion of the negotiations on Rules of Origin between the Parties pursuant to paragraph 3 of Article 2 of the Protocol;

REAFFIRMING the intention of the Parties to allow limited flexibility with respect to the implementation of their Tariff Schedule which appears as Appendix 2 to Annex 1 of the Protocol;

DESIRING to accelerate the realization of benefits from the liberalization of trade in goods between the Parties;

HAVE AGREED AS FOLLOWS:

ARTICLE 1
RULES OF ORIGIN

The Parties agree to establish Rules of Origin and procedures for qualification, certification, verification and control of the origin of the goods as set out in Appendices I (including its Headnotes), II and III which appear as Attachments 1, 2 and 3 to this Additional Protocol to the Protocol between the Kingdom of Thailand and the Republic of Peru to Accelerate the Liberalization of Trade in Goods and Trade Facilitation (hereinafter referred to as the “Additional Protocol”).

ARTICLE 2
TARIFF SCHEDULE

Appendix 2 (Tariff Schedule) of Annex 1 (Trade in Goods) of the Protocol shall be replaced by the new Appendix 2 (Tariff Schedule) which appears as Attachment 4 to this Additional Protocol.

ARTICLE 3
FINAL PROVISIONS

1. This Additional Protocol and its Attachments shall form an integral part of the Protocol.

2. The tariff elimination program shall enter into effect after the Parties complete their respective internal procedures.

3. The Parties shall enter into consultations to discuss any necessary revisions for the changes into the Harmonized Commodity Description and Coding System 2007, including Attachment 1 of this Additional Protocol.

4. Each Party shall notify the other Party of the completion of its internal procedures for the entry into force of this Additional Protocol.

5. This Additional Protocol shall enter into force thirty days after the date of receipt of the latter of the notifications referred to in paragraph 4. Unless otherwise specified in subsequent Agreement between the Parties, it shall remain in force until the date of the entry into force of the Peru – Thailand Free Trade Agreement.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Additional Protocol to the Protocol between the Kingdom of Thailand and the Republic of Peru to Accelerate the Liberalization of Trade in Goods and Trade Facilitation.

DONE at Hanoi, Socialist Republic of Vietnam on this 16 day of November 2006; in duplicate, in the Thai, Spanish, and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.
